Well I will be having a hearing here in Calif. with someone from the DMV regarding my license sometime in November. My license was suspended, my doctor faxed in paperwork clearing me and now I will have this hearing.

Can anyone give me a little insight on what to expect at this hearing? What/who should I bring with me?

Any info would be greatly appreciated.

I sorta had something similar. Though it didnt get suspended. My Dr faxed paper work saying it was isolated and I hadnt had one in a while (hence I was driving) and he was changing my meds and in the process of getting me started in a better direction. Well, I talk to the Safety board on the phone but never had to actually go to a meeting, and then I had to go down to the DMV and take a driving test. I passed and kept my license and no actions were taken against me.

However, since your's has allready been taken I do not know what will happen. Every case is different. I know a lot of what happends depends on what your doctors says and how he feels (like a recomendation).

Good Luck. I hope other members can be of more help.

A hearing is basically this - I have went through
this under my own State - I do not know how it
will work under your State:

What Brainy went through:

1 ) Typically you will be in an office with
a DMV Supervisor or Medical Supervisor

2 ) He/She will review the records

3) He/She will disclose as to why they had
determined your license was/is in suspension
stage =OR- why you are being evaluated

4 ) I strongly recommend that you bring in:
a) a copy of the letter of clearance from
your Doctor (even though he/she had
sent them one) ask them to mail you a
copy
b) a copy of several EEG reports
c) a copy of your Lab Reports
d) a short notation from your Doctor of
your current medication
e) type of seizure(s) you have (It is of
interest that "nocturnal seizures" should
not be a reason why one cannot drive;
for one does not drive during their sleep
in phase II - IV - and it would be helpful
to print out a resource from the Internet
especially from an Education Site - or a
Medical Site in regards to "nocturnals"; if
you are a nocturnal only individual)
f) proof that your seizures are controlled
g) DO NOT ARGUE! Remain calm at all times!

5 ) Let THEM evaluate you. Maybe someone had
"reported" you just for the sake of it just to be
'obnoxious' because they know you have Epilepsy.

6 ) It is not unusual for them to determine that
you are fit to drive and override the suspension
and determine that all facts are warranted and
you become eligible.

7 ) They may request their own Neurologist of their own to
perform an examination and evaluation (this is funded by the State)
a) You might have to do a Driving Test and a
Road Test
b) Your previous Driving History will be reviewed
c) You might even be sent for a Physical that is
selected by them (also funded by the State)
d) You may or may not be granted temporary
driving privileges to go to those appointments.

8 ) If they determined you were eligible and deemed
no further action, you would be able to obtain your license
back without much ado. But if additional steps are required;
then that must be performed. Then you will receive another
appointment or a letter stating your end results. Usually it
would state you are eligible, and if not, it would state specifically
why you were denied.

Personally, I have never been denied, I have
always complied to all their requests and
demands for years. But this is only in my State. Every State is different.

BUT remember - PLAY IT COOL!
REMAIN CALM. Be mellow as much
as possible no matter how annoying
some of them are. And always remember
this: It's "YES SIR" or "NO MA'AM".
Showing Respect is the MAJOR KEY!
They LOVE THAT - they feed off of that,
so talk to them like they're the "Ultimate
Supreme Beings on Planet Earth".

(But you didn't hear this secret from me)

;)

Angelais,
I have not been to a California DMV hearing as I have only been recently diagnosed. Can I ask you how long California DMV suspended your drivers license for? My Doctor has said he has faxed them and I am now awaiting notification from them that makes if official.
Good luck on your hearing.
Brain had some really great suggestions. Thanks Brain, I have printed them out so I can use them when I get reinstated.
Take care,
Mike
